    At Clare Facio Legal, we have observed with interest the recent modifications in Costa Rica’s immigration policies related to the length of stay allowed for tourists. In order to provide a clearer understanding of this change, we would like to share the following analysis.

    On June 15, Costa Rica implemented an amendment to the Regulation for the Granting of Entry Visas, extending the period of stay for tourists belonging to a specific group of 60 countries, from 90 days to 180 days. This modification affects nationals of countries such as the United States, Denmark, Spain, Germany, France and Canada. At the end of this article you will find the complete list of countries and their dependencies that apply to the term extension.

    This measure, promoted by the Ministry of Economy under the leadership of Francisco Gamboa, is part of a series of actions that the government has baptized as the “Let him work” strategy. This series of measures seeks to eliminate certain “bottlenecks” that have been identified as limiting factors in different sectors of the country.

    Mr. Gamboa highlighted the request made by the National Chamber of Tourism (Canatur) to carry out this expansion.     ¿Qué es una marca y por qué es tan importante su registro? Aspectos importantes del Registro de Marcas en Costa Rica.

    La marca es la tarjeta de presentación de cualquier empresa de productos o servicios ante el público consumidor final. Este activo intangible es el responsable de darle identidad al negocio, y en consecuencia, el prestigio que todo empresario desea. Es el signo que se necesita que se distinga entre tantos otros y el cual se quiere que toda persona dentro del mercado identifique y relacione con el producto o con el servicio que se ofrece a la venta.

    Es tendencia en Costa Rica que las personas al desarrollar su negocio se centren primero en el local comercial que van a utilizar, la estrategia financiera, el modelo de negocio, la cartera de clientes y como último paso con carácter de menos importancia se deja el registro de marca.

    Es algo normal en la práctica de Propiedad Intelectual atender clientes quienes ya tienen su negocio y recursos invertidos en este que desean registrar su marca y se topan con la desagradable sorpresa de que el nombre comercial o la marca de sus productos o servicios tienen bajas probabilidades de éxito de registro ya sea porque la marca no es lo suficientemente distintiva o porque ya existen marcas registradas iguales o similares en la clasificación de NIZA que se desea registrar.

    Algunos ingresan su solicitud ante el Registro de Propiedad Industrial sin realizar una previa búsqueda de antecedentes marcarios y no continúan el proceso hasta obtener el certificado de registro por prevenciones de forma o de fondo que son notificadas por esta entidad las cuales pueden ser atendidas por medio de herramientas que la propia ley costarricense le brinda al usuario.

    Para evitar que la inversión y los esfuerzos para construir su negocio se desperdicien, siempre se recomienda la inscripción de la marca de forma prioritaria.

    Costa Rica posee una Ley de Marcas y Otros Signos Distintivos que nos indica cuales de ellos
    se pueden registrar y bajo que requisitos; que características deben de tener y que definitivamente no es registrable. Tenemos a nuestra mano las herramientas necesarias para poder obtener un registro exitoso; ademas contamos con un Registro de la Propiedad Intelectual, qué a diferencia de muchas entidades públicas, es efectivo, rápido y seguro.

    Dicho lo anterior, a continuación la respuesta a algunas preguntas lógicas que estén pasando
    por su mente:

    1. ¿Qué es la clasificación de Niza?
      La Clasificación de Niza, establecida por el  Arreglo de Niza  (1957), es una clasificación
      internacional de productos y servicios que se aplica al registro de marcas. Es un listado
      organizado por números que nos detalla bajo que numeración son ubicados los productos y
      servicios que van a proteger las marcas. Por ejemplo, si quiero registrar una marca de ropa,
      la solicitud debe de ser ubicada en la clase 25 que protege “ropa, abrigos,artículos de
      sombrería” entre otros.  Costa Rica pertenece a este arreglo por lo que se utiliza esta
      clasificación para la ubicación y correcto registro de las marcas ante el Registro de Propiedad
      Intelectual de Costa Rica.
    2. ¿Que sucede si no registro mi marca?
      Al no registrar nuestra marca, corremos con el riesgo de que una tercera persona pueda
      apropiarse legítimamente de mi signo, derivando esto en tener que desechar todo aquello
      en lo que se ha invertido tanto tiempo y recursos como por ejemplo: rótulos de

    establecimientos, publicidad, papelería rotulada, productos de propaganda (vasos, lapiceros,
    carpetas entre otros) sin tener ninguna herramienta legal para poder reclamar derechos.

    1. ¿Ante cual entidad debo registrar mi marca?
      En Costa Rica, las marcas deben ser solicitadas ante el Registro de Propiedad Intelectual.
    2. ¿En que momento debo solicitar el registro de mi marca?
      La marca puede registrarse en cualquier momento; sin embargo es recomendable hacer la
      solicitud antes de comenzar el giro comercial del negocio.
    3. ¿Cuales aspectos debo de tomar en consideración para el diseño de mi marca?
      La Ley de Marcas y Otros Signos Distintivos número 7978 en el artículo 03 describe lo que se
      considera una marca, por ejemplo: palabras o los conjuntos de palabras, letras, números,
      cifras, elementos figurativos, combinaciones de colores, sonidos, las formas, envases o
      envolturas de expendio de productos. Asimismo, esta Ley nos brinda específicamente en el
      artículo 07 lo que no es considerado una marca, por ejemplo: designación común o usual del
      producto o servicio, un signo que califica o describe características del producto o servicio,
      un simple color, letra o un dígito aisladamente, un signo que sea contrario a la moral o el
      orden público, que pueda causar engaño o confusión sobre su procedencia, cualidades o
      características, que reproduzca el escudo, la bandera u otro emblema de cualquier Estado
      sin autorización, monedas o billetes de curso legal en el territorio de cualquier país, o
      aquellos que sean inadmisibles por derechos de terceros esto refiriéndose a que el signo no
      puede ser similar o igual a una marca registrada en la misma clasificación de Niza. Cabe
      resaltar que signos iguales o similares si pueden coexistir si estos protegen productos o
      servicios catalogados en diferentes clases de acuerdo con la clasificación mencionada.
    4. ¿Cuales son los requisitos para registrar mi marca?
      Los requisitos para el registro de marca son muy sencillos; se necesita: poder especial original en
      español debidamente notarizado (en caso de que la solicitud sea presentada por una tercera
      persona en representación del titular de la marca), datos completos del titular de la marca,
      domicilio exacto del titular de la marca, nombre y clase de la marca, productos o servicios que
      desea proteger, diseño en formato jpg. (en caso de que el signo mixta (combinación entre letras
      y logo) o figurativa (logo)).
      Asimismo, siempre se recomienda realizar una búsqueda de antecedentes marcarios en la base
      de datos del Registro de Propiedad Industrial en aras de constatar que no existan marcas iguales
      o similares las cuales vayan a representar un obstáculo para el registro de mi signo así evitando
      lo establecido el en artículo 07 de la Ley de Marcas y Otros Signos Distintivos.
    5. ¿Cuales son los beneficios que otorga el registro marcario?
      El registro de marca otorga a su titular el uso y disfrute exclusivo del signo traduciéndose en
      un beneficio económico, la posibilidad de otorgar licencias y mas importante aún, la
      protección ante terceros quienes quieran utilizar o apropiarse de forma ilegitima de mi
      marca.
    6. ¿Cuanto dura el proceso de inscripción de registro marcario en Costa Rica?
      Si el Registro de Propiedad Industrial no tiene objeciones de forma y de fondo ante la
      solicitud de marca, el plazo para que esta quede registrada es de 3 meses aproximadamente.
    7. ¿Por cuanto tiempo estará protegida mi marca?
      El plazo de protección en Costa Rica es de 10 años.
    8. ¿Que sucede cuando este tiempo vence?
      Como titular de la marca, debo de estar atento a la fecha de vencimiento de mi registro para
      poder solicitar la renovación antes de dicha fecha. Si por alguna razón, la renovación
      marcaria no se ingresó a tiempo, se tiene el llamado “plazo de gracia” el cual es un plazo de
      6 meses que otorga el Registro después del vencimiento de la marca para que esta sea
      renovada; si la marca se ingresa durante este plazo, en tasas oficiales se tiene un costo
      adicional. En caso de que el plazo de gracia haya vencido, la marca debe ser solicitada
      nuevamente.
    9. ¿Que pasa con el registro marcario si mi negocio se extiende a nivel internacional?
      El registro de marca es territorial, es decir que este derecho solo aplica para Costa Rica; sin
      embargo, la marca puede ser registrada en otras jurisdicciones donde se desarrolla el
      negocio siempre y cuando esta cumpla con los requisitos de cada país.

    Background.

    Mr. Manuel Álvarez Méndez (Spanish) disappeared in Costa Rica in 2018, after having returned to the country on January 10 of that same year. He had returned after being alerted by acquaintances that his properties were being stolen and transferred to others through registry fraud.

    The Alajuela Judicial Investigation Agency (OIJ) carried out two raids in La Garita and Turrucares, but did not obtain positive results. The lawyer for the family of the disappeared person expressed her concern about the possible connection of a criminal group with the case, which further complicates the search.

    It is known that Manuel Álvarez Méndez had at least eight properties registered in his name in the National Registry at the time of his disappearance. However, judicial sources indicate that there could be up to 17 farms, located in places such as La Garita and Tambor de Alajuela, San Rafael de Poás, Aguas Zarcas de San Carlos, Santa Ana, Escazú, Goicoechea and Nicoya.
